Ace Memorial

Please read these Terms carefully. By using Ace Memorial or filling the google form, you’re agreeing to these Terms, which will result in a legal agreement between you and Ace Memorial (“Agreement”). We’ll start with the basics, including a few definitions that should help you understand these Terms. Ace Memorial (“we,” “us,” or “our”) is an online formatting service platform that provides you formatting services for your moot memorial, law books, research project, research papers, negotiation & mediation plans, among other things. The services are offered through our website: http://www.acememorial.wordpress.com. Ace Memorial has employees, experts, and representatives (“our Team”). As a customer of our Services or a representative of an entity that’s a customer of our Services, you’re an “offeror” for our services according to this Agreement (or “you”).

These Standard Terms of Use (“Terms,”) define the terms and conditions under which you’re allowed to use the Service in accordance with the Agreement, and how we’ll treat your data while you’re an offeror. If you don’t agree to these Terms, you must immediately discontinue your use of our Services.

In order to use the Services, you must:

1. Be at least eighteen (18) years of age.
2. Complete the registration process via google form;
3. Agree to these Terms;
4. Provide true, complete, and up-to-date contact and billing information;

By using the Service, you represent and warrant that you meet all the requirements listed above, and that you won’t use the Service in a way that violates any laws or regulations. Note that by representing and warranting, you are making a legally enforceable promise.

Ace Memorial shall refuse services, close services of any offeror, and change eligibility requirements at any time.

We will not accept the submissions of those moot memorials, that will be in conflict of interest of any of Team Members of Ace Memorial. Such Moots shall be notified in advance on the homepage of our website.

Ace Memorial does not violate any rule of moot court competitions or any other competitions and aims to help the law students, who lag behind from others due to lack of necessary formatting skills and resources.

Ace Memorial may reject any document for formatting at any point of time. The reason may be slots being full or any other reasonable reasons. On any conflict the decision of Ace Memorial shall be final and binding.

When you fill the google form or purchase our services or agree to these Terms, the Agreement between you and Ace Memorial is formed, and the term of the Agreement will begin. The term of the agreement will continue for as long as service agreement is completed or until you or we terminate the Agreement in accordance with these Terms, whichever happens first. If you fill the google form or purchase our service or agree with these terms on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms and enter into the Agreement on its behalf.

You or Ace Memorial may terminate the Agreement at any time and for any reason by discontinuing our services or by rejecting your application in the google form. We may suspend the Services at any time, with or without cause. If we terminate your service and if you had paid for our service, we’ll refund your amount in the account details provided by you. We won’t refund or reimburse you, if you breach or violate any of the terms of the Agreement. Once the agreement is completed, you acknowledge and agree that we may permanently delete all the data associated with it, including your submissions to us in the google form. If the service has been terminated, the data will no longer be available for use on any future accounts and cannot be reclaimed.

We may change any of the Terms by posting revised Terms on our Website. Unless you terminate your service, the new Terms will be effective immediately and apply to any continued or new use of the Service. We may change the Service, Add-ons, or any features of the Service at any time, and we may discontinue the Service, Add-ons, or any features of the Service at any time.

Your privacy is important to us. Please read our privacy policy for information regarding how we collect, use, disclose your data and personal information and protect your privacy when you use the Service.

By agreeing to these Terms, you promise to follow these rules:

1. You won’t send spam!
2. You’ll comply with our privacy policy, which forms part of these Terms.
3. you’ll comply with these Terms & Conditions.

To this end, we may suspend or terminate your service if you send or otherwise distribute any Content that we determine, in our sole discretion, contains either of the following: 1. A Threat of Physical Harm 2. Hateful Content.

We may also suspend or terminate your services if we determine, in our sole discretion, that you are either:

• an organization that has publicly stated or acknowledged that its goals, objectives, positions, or founding tenets include statements or principles that could be reasonably perceived to advocate, encourage, or sponsor Hateful Content or A Threat of Physical Harm;
• a person that has publicly made a comment or statement, or otherwise publicly made known a position, including by membership in an organization, that could be reasonably perceived as Hateful Content or A Threat of Physical Harm; or
• a person or organization that has acted in such a way as could be reasonably perceived to support, condone, encourage, or represent Hateful Content or A Threat of Physical Harm.

If you violate any of these rules, then we may suspend or terminate the service.

If you think anyone is violating any of these Terms, please notify us immediately. If you receive any spam, you think came from an Ace Memorial Member, please report it to our team. 

You represent and warrant that your use of the Services will comply with all applicable laws and regulations enforce in india and outside india. You’re responsible for determining whether the Service is suitable for you to use in light of your obligations under any regulations in india and outside india.

To the maximum extent permitted by law, you acknowledge and agree that (i) you assume full responsibility for any loss that results from your use of the Service, including any downloads from the Website; (ii) we and our Team won’t be liable for any indirect, punitive, special, or consequential damages under any circumstances, even if they’re based on negligence or we’ve been advised of the possibility of those damages; and (iii) in any calendar month, our total liability to you arising under or in connection with the Agreement—whether in contract, tort (including negligence), breach of statutory duty, or otherwise—will be no more than what you paid us for the Services. For the avoidance of doubt, in no instance will we or our Team be liable for any losses or damages you suffer if you use the Service in violation of these Terms, regardless of whether we terminate or suspend your service due to such violation.

To the maximum extent permitted by law, we provide the Service as-is. This means that, except as expressly stated in these Terms, we don’t provide warranties, conditions, or undertakings of any kind in relation to the Service, either express or implied. 

You also agree to indemnify and hold us harmless from any losses, including legal fees and expenses, that directly or indirectly result from (i) your Content, (ii) your use of the Service, (iii) your violation of any laws or regulations, (iv) third-party claims that you or someone did something that, if true, would violate any of these Terms, (v) any misrepresentations made by you, or (vi) a breach of any representations or warranties you’ve made to us.

The violation of these Terms on your part may cause irreparable harm to us and our Team. Therefore, we have the right to seek injunctive relief or other equitable relief if you violate these Terms (meaning we may request a court order to stop you).

We and our Team aren’t responsible for the behavior of any third parties, linked websites, or other Members.

The indian laws, will apply to any dispute related to the Agreement or the Service. You acknowledge and agree that any dispute related to the Agreement or the Service itself will be decided by way of arbitration, and each party consents to personal jurisdiction in those tribunals.

We won’t be held liable for any delays or failure in performance of any part of the Service, from any cause beyond our control. This includes, but is not limited to, act of god, changes to law or regulations, embargoes, war, terrorist acts, riots, fires, earthquakes, nuclear accidents, zombie apocalypse, floods, strikes, power blackouts, volcanic action, unusually severe weather conditions, and act of hackers, or third-party internet service providers.

These Terms and any additional terms you’ve agreed to by purchasing any service or filling the google form make up the entire agreement between us in relation to its subject matter and supersede all prior agreements, representations, and understandings.
